Before posting, ask a defense attorney about own recognizance, lower bail, $0 pre-arraignment release or cash bail. Posted premiums are generally nonrefundable. 10 CCR 2090 requires a refund if the agent surrenders the defendant before a court date; PC 1300(b) lets a judge order one if a surrender lacked good cause.
Expect a $500 premium, the standard 10% of $5,000 bail. If you qualify for our filed 8% rate, the figure drops to $400. We can split the premium into smaller payments on a written plan, and Penal Code 1276.1 keeps it a one-time charge for the life of the bond.
You deposit the full $500 as cash bail, and no premium applies. Under Penal Code 1297, the court can apply a defendant’s own deposit to restitution, fines and costs before refunding the rest. A relative who made the deposit receives all of it after judgment, within 10 days of submitting the receipt.
