Probation Situations and What a Bond Can Do
Probation cases follow different release rules from a first arrest. We sort Pomona calls into the six situations below, and only some of them leave room for a bond.
A judge may issue a rearrest warrant under PC 1203.2 when a probation officer reports a violation, or a PC 978.5 bench warrant after a missed court date. After the arrest, the court must weigh release under PC 1203.25.
An officer with probable cause may rearrest someone on probation without a warrant. LA County’s 2026 misdemeanor schedule lists that arrest as Magistrate Review, and a magistrate, available at any hour, may release them, add conditions or hold them until arraignment.
On felony probation, parole or PRCS, a new charge listed as Cite and Release or Book and Release goes to Magistrate Review instead. The 2026 schedule says the magistrate takes no action on the probation case itself.
Summary probation has no probation officer, yet PC 1203.2 still applies. Before the formal violation hearing, PC 1203.25 bars denying release to a misdemeanor probationer unless they ignored a court order, such as an order to appear.
LA County Probation supervises PRCS and state agents supervise parole; either can order flash incarceration of 1 to 10 days in jail. Otherwise a judge may order release on terms the court sets. The 2026 schedules list no bail for either hold.
If a new felony carries money bail, the 2026 schedule adds $25,000 for felony probation or parole. We can bond it, but under PC 1269b(g) the jail frees them only on that charge, so a probation hold can keep them inside.

These questions come up after probation arrests: whether we can bond someone out, and what no bond means. Each answer draws on California law and LA County’s 2026 schedules.
Yes, on a new charge with money bail, and we check any probation warrant for a bail amount. On the violation itself, PC 1203.25 makes own recognizance release the court’s default. If the court sets bail there, the statute calls it cash bail and says a bail bond is not bail.
It means the court set no bail: there is nothing to post, and the person stays in custody until a judge rules. Before the formal hearing, PC 1203.25 allows denial for someone on misdemeanor probation only after a disobeyed court order, and on felony probation only on clear and convincing evidence.
A warrantless violation arrest leaves no bond to post. The Pre-Arraignment Release Protocol lists it as Magistrate Review, which is $0 but not release: a magistrate can still hold them until arraignment. A Cite and Release or Book and Release charge also goes to Magistrate Review on felony probation, parole or PRCS.
Pay cash only if you can spare the full bail until the case ends. After judgment, PC 1297 returns a relative’s cash in full when claimed with the receipt, while a defendant’s deposit can first cover restitution, fines and costs. A bond premium stays with the agency if prosecutors drop charges.
At the standard 10% premium, a $25,000 bond costs $2,500. If you are a veteran or service member, belong to a union or hired a private attorney, a filed 8% rate of $2,000 may apply. The 2026 felony schedule adds $25,000 to money bail for felony probation.
