This charge needs no weapon; force likely to produce great bodily injury is enough. Without an enhancement or other charge, it goes to Magistrate Review, where a magistrate may release on own recognizance, set non-financial conditions or hold the arrestee until arraignment.
With a semiautomatic firearm, the charge is PC 245(b): three, six or nine years in state prison and no county jail option. Bail on the 2026 felony schedule is $75,000, so the standard premium is $7,500.
PC 245(c) covers a deadly weapon other than a gun, or force likely to produce great bodily injury, used on a peace officer or firefighter the person knew or should have known was performing their duties. Its felony schedule row reads $50,000.
Prosecutors use PC 243(d) when a battery causes serious bodily injury, which the statute says includes loss of consciousness or a wound needing extensive suturing. Charged as a felony, it carries $50,000 bail and a serious-felony mark on the 2026 schedule.

The California Constitution, art. I, sec. 12, lets judges refuse bail in capital cases when the facts are evident or the presumption great. Felonies involving violence or threats also need clear and convincing evidence of a substantial likelihood of great bodily harm. The 2026 schedule marks special-circumstance murder INELIGIBLE FOR RELEASE.
A $1,000 bond costs $100 at the standard 10% premium, or $80 if you qualify for a filed 8% rate as a veteran, service member, union member or private-attorney client. Aggravated assault bail runs higher: the lowest PC 245 dollar figure on the 2026 felony schedule is $30,000.
