With no disqualifying prior, stealing $950 or less (firearms excluded) is PC 488 petty theft, Cite and Release; shoplifting, PC 459.5, is Book and Release. Two or more theft-related priors allow a PC 666.1 charge, a Magistrate Review wobbler.
PC 242 defines battery as any willful and unlawful use of force on another person. PC 243(a) caps the penalty at six months in county jail and a $2,000 fine, and the 2026 schedule lists it as Book and Release at $0.
Battery against a spouse, cohabitant, co-parent or a current or former dating partner is PC 243(e)(1). PC 1270.1 requires an open-court hearing before own-recognizance or off-schedule bail, so the scheduled $20,000 applies until then.
Driving under the influence, or at 0.08% blood alcohol, violates VC 23152; VC 23536 sets a first-offense range of 96 hours to six months in jail. The schedule lists Book and Release, but two priors in ten years mean Magistrate Review.
PC 647(f) covers someone in public too intoxicated to keep themselves or others safe, or blocking a sidewalk. It is Cite and Release at $0, and in alcohol-only cases PC 647(g) calls for civil protective custody when officers are able.
Vandalism under PC 594 means defacing, damaging or destroying someone else’s property with malice. Under $400 in damage it is Cite and Release, or Book and Release with a prior; at $400 or more it can be a felony, also Book and Release.

Misdemeanor Bail Bond FAQ

Often, no. PC 1270 entitles a misdemeanor defendant arraigned in custody to own-recognizance release unless the judge finds on the record that it would compromise public safety or fail to assure appearance. PC 977 lets a lawyer appear alone at most misdemeanor hearings, but domestic violence arraignments need the defendant there.
Sometimes. For PC 1270.1 offenses like domestic battery, you post the scheduled amount or wait for an open-court hearing. A warrant carries its own PC 815a bail, outside the Pre-Arraignment Release Protocol, and felony probation or parole triggers Magistrate Review, where a magistrate may hold the person.
The bond costs $100, the standard 10% premium; paying the court $1,000 in cash is the other route. A judge can set bail at arraignment, at a court such as Pomona Courthouse South. Our bail bond cost guide covers payment plans and the 8% rate some clients qualify for.
The new charge’s track governs until arraignment; then a judge can set bail. Agents surrendering you before a court date must refund the premium (10 CCR 2090), keeping limited costs only on proof of substantial added risk; a new charge with no greater penalty than the first is not, alone, reasonable cause.
A dismissal exonerates the bail under PC 1384, and the clerk refunds any cash deposit. A relative’s deposit comes back in full, within 10 days of a claim with the receipt (PC 1297). We keep the premium, except in the 10 CCR 2090 and PC 1300(b) surrender cases.
