Not for the debt. Article I, section 10 of the California Constitution bars jail in a civil action for debt, and an unpaid premium is contract debt. Penal Code 1300 does let a bail agent surrender a defendant to custody before forfeiture, so call us if a payment will run late.
We return it under the contract once you pay off the premium and the court exonerates, or cancels, the bond. Exoneration comes when the case ends, or when a defendant who missed court appears within the Penal Code 1305 window. If the forfeiture becomes final, the collateral can cover the bail owed.
