Bail Surety Bonds We Post
Penal Code 1269b lets a jail officer, or a clerk such as the one at Pomona Courthouse South, accept bail as a surety bond from a certified, admitted surety insurer. Six situations follow.
Once a judge or the county schedule sets bail, the surety promises the court that sum if the defendant misses court. You pay the insurer’s state-filed premium, a standard 10% of bail, and our bail vs. bond guide compares that with cash.
Under Penal Code 815a, the judge issuing an arrest warrant for a bailable offense fixes bail and endorses the amount on it. LA County’s pre-arraignment protocol covers only warrantless arrests, so we confirm that figure and arrange the bond before surrender.
An arrest across the county line can mean booking at West Valley Detention Center, 9500 Etiwanda Ave in Rancho Cucamonga. Without a warrant, bail follows San Bernardino County’s schedule under PC 1269b; a warrant carries its own amount. We post bonds there too.
ICE or an immigration judge can release an eligible detainee on a bond of at least $1,500 under 8 U.S.C. 1226. A Treasury-certified surety can post it, and the obligor must produce the person whenever ICE sends a delivery notice.
After a conviction for an offense not punishable by death or life without parole, Penal Code 1272 allows bail pending appeal. It is a matter of right on most misdemeanor appeals and the judge’s discretion otherwise. A surety bond covers the amount set.

Surety Bail Bond FAQ
The answers below cover what a bail surety bond costs and what happens after a missed court date. California bail law governs both, and contractor or license bonds follow different rules.
For a bail bond, the standard premium is 10% of bail, at a rate the surety insurer files with the California Department of Insurance. A filed 8% rate may apply to veterans, union members and private-attorney clients. Beyond the premium, 10 CCR 2081 allows only collateral and actual, necessary expenses.
At the standard 10%, $25,000 bail means a $2,500 premium. The same math puts a $10,000 bond at $1,000 and a $100,000 bond at $10,000. Our bail bond cost guide covers payment plans, and an agent may ask for a cosigner or collateral on a large bond.
Only when bail has a dollar amount. The county’s Pre-Arraignment Release Protocol sets $0 bail on charges marked Cite and Release or Book and Release. On a Magistrate Review charge, a magistrate may release the arrestee or hold them until arraignment. A warrant keeps the bail the judge wrote on it.
Dismissal exonerates the bond, but the agent keeps the premium. Under 10 CCR 2090, an agent who surrenders the defendant before a court date owes a refund and may keep limited costs only after showing substantially increased risk. PC 1300(b) lets a judge order one after a surrender without good cause.
Under PC 1305, the court declares a bond forfeited when the defendant misses court without sufficient excuse. Appearing within 180 days, plus five when the court mails notice, vacates it. If that window closes without a set-aside, PC 1306 requires summary judgment against the surety, which may collect from the cosigner.
