Immigration Bond Types and ICE Situations
You can cover an immigration bond two ways: deposit the full amount with ICE as a cash bond, or pay a surety a premium to post it. The duties differ by bond type.
With a delivery bond, a detainee leaves custody while the removal case runs. Under 8 USC 1226(a), it must be at least $1,500. The signer, or obligor, must have the person report to ICE each time a Form I-340 notice arrives.
Judges who grant voluntary departure at the close of a case set a bond of at least $500 under 8 CFR 1240.26. It goes to ICE within 5 business days, and ICE cancels it after proof of an on-time departure.
If ICE denies bond or sets it too high, the detainee may ask an immigration judge to redetermine it before a final order (8 CFR 1236.1). Section 1003.19(h) and other federal rules can bar that review; ask an immigration attorney.
Under 8 USC 1226(c), ICE must hold people under listed criminal or terrorism grounds, and no bond is possible. The list now reaches certain inadmissible noncitizens charged with theft or burglary. A judge can still decide whether the person belongs in a group.
A detainer asks a jail to notify ICE before a release, and county bail does not cancel it. California’s Values Act bars jails from holding anyone on a detainer alone and allows transfers only with judicial approval or under Gov Code 7282.5.
Paying cash means sending the full amount to ICE through its CeBONDS system by Fedwire or ACH. The obligor must show ID as a U.S. citizen or permanent resident, with limited exceptions. A surety bond must come from a Treasury-certified company.

A delivery bond starts at $1,500. Cash means depositing the full amount with ICE; a surety charges a premium. California court bail premiums run most often 10%, or $500 on a $5,000 bond. An ICE bond premium can differ, so we quote it and any collateral in writing before you sign.
Release lasts while the removal case is pending, if the person reports whenever ICE sends a delivery notice. The bond stays in effect until ICE cancels it with Form I-391, and ICE may revoke it at any time. Penal Code 1276.1(b) allows one premium however long it lasts.
No one can promise a time. ICE reviews bond postings only on weekdays other than government holidays, 9 a.m. to 3 p.m. local time where ICE holds the person, and moves unfinished requests to the next business day. The detention facility then schedules the release.
For the criminal charge, LA County’s Pre-Arraignment Release Protocol may mean $0 release, but it covers state arrests only and has no effect on ICE custody. If an ICE detainer exists, ICE may still seek custody after county release, and any ICE bond is a separate federal decision.
