Why Families Trust Us With Pomona Appeal Bonds
Our Pomona appeal bonds are criminal bail. A civil supersedeas bond, which stops enforcement of a money judgment during an appeal under Code of Civil Procedure 917.1, is a separate product.
In our experience, release takes 2-6 hours once a bond posts. On an appeal, that clock starts only after a judge grants bail, and we promise nothing about the ruling.
The premium is 10% of the bail the court sets, and we list other costs in writing before you sign. The Department of Insurance calls the premium nonrefundable, apart from some surrender cases.
Under Penal Code 1276.1, no bail licensee may collect a renewal premium after 2021. The agreement lasts until the court exonerates bail, so one premium carries the bond through the appeal.
A low down payment starts the bond, and a written plan covers the rest. A filed 8% rate may be open to veterans, active-duty troops, union members and clients of private attorneys.
We handle the bond forms. If your loved one is in an LA or San Bernardino County jail after sentencing, we post the bond there and call you once the jail accepts it.
How Bail Pending Appeal Works
After a conviction, Penal Code 1272 makes bail a right in most misdemeanor appeals and a judge’s choice in felonies, and it excludes offenses punishable by death or life without parole.
The right attaches when a misdemeanor appeal challenges a jail sentence, and PC 1272(a) extends it to any appeal from a fine-only judgment. It also covers the time between a misdemeanor conviction and sentencing while a probation application is pending.
PC 1272.1 requires release on clear and convincing proof the person is not likely to flee and endangers no one, if the appeal is not for delay and raises a substantial legal question likely to bring reversal if decided in their favor.
PC 1237 and 1466 let the defense appeal a probation grant and seek a stay, under Rule 8.312 in felonies or 8.854 in misdemeanors. PC 1203.25 makes bail on a violation itself cash only, so no bond covers it.
A person held on a criminal charge for lack of bail can seek a writ of habeas corpus to give bail under Penal Code 1490. Rule 8.312’s advisory comment calls a bail application on appeal separate from, but consistent with, that writ.
Outside death penalty cases, filing an appeal does not pause a sentence. Penal Code 1243 for felonies and 1467 for misdemeanors leave a stay to the trial or reviewing court’s discretion, though no court may stay a PC 290 registration duty.
A bail request starts in the superior court, such as Pomona Courthouse South. After an unjustified denial, the defense applies to the Second Appellate District in an LA County felony (Rule 8.312) or the appellate division in a misdemeanor (Rule 8.854).

Three Simple Steps to a Bail Bond
Call (888) 998-9511 at any hour. Once bail has a dollar amount, you sign the agreement and make a low down payment on the standard premium, 10% of bail.
We spread the premium balance over a written plan that fits your budget. Penal Code 1276.1 bars a second premium on the same bond, however long the case runs.
A licensed agent posts the bond with the facility holding your loved one. Each jail controls its own processing time, and we keep your family updated from posting until release.

Appeal Bond FAQ
Two of these answers work through the premium math for appeal bonds in Pomona. Others cover LA County’s zero bail rules and what the bond promises the court if the appeal fails.
Expect a premium of 10% of the appeal bail the judge sets: $2,000 on $20,000. If you qualify for a filed 8% rate, it is $1,600. In discretionary cases, a bail motion made after sentencing needs at least five court days’ notice to the prosecutor under PC 1272(c).
A $50,000 criminal bail surety bond costs a $5,000 premium at 10%, or $4,000 if you qualify for a filed 8% rate. On $25,000 bail the premium is $2,500. A civil appeal bond is another product, sized under CCP 917.1 at up to twice the judgment.
For an appeal, yes, if a judge sets money bail and your family does not deposit the full amount in cash. The Pre-Arraignment Release Protocol covers warrantless arrests until arraignment, and its designations do not bind the arraignment judge. Appeal bail rests on Penal Code 1272 and a judge’s order.

Yes. If the sentence includes custody, Penal Code 1273 ties appeal bail to a promise to surrender if the reviewing court affirms or modifies the judgment or dismisses the appeal. Skipping that surrender without sufficient excuse leads to forfeiture under PC 1305. Our guide to what happens after posting bail explains exoneration.
