No. The state Constitution bars jail for unpaid premium, a contract debt. Premium is nonrefundable, but under 10 CCR 2090 an agent surrendering a client before court returns it, minus limited costs if risk rose substantially, and Penal Code 1300(b) lets a court order a refund after a surrender without good cause.
It depends on whether your family can tie up the full bail until the case ends. Under Penal Code 1297, a relative who deposits cash gets it all back after judgment. A bond costs a nonrefundable premium, 10% as standard, but leaves savings free; our bail vs bond guide compares both.
At the standard 10% rate, a $75,000 bond carries a $7,500 premium. A client eligible for the filed 8% rate would pay $6,000. We can split that premium into a written plan with a low down payment, and Penal Code 1276.1 keeps it a single charge.
