Possessing a drug covered by Health and Safety Code 11350 is a misdemeanor unless certain priors apply, and the 2026 misdemeanor schedule lists it as Cite and Release. Possession for sale under 11351, a felony, still appears as Book and Release at $0.
Simple assault, punished under Penal Code 241, and simple battery under 243(a) both show Book and Release on the 2026 misdemeanor schedule, so booking ends with a court date. Battery against an elder or dependent adult, 243.25, goes to Magistrate Review instead.
Barring certain priors, theft up to $950 is a misdemeanor under Proposition 47, and petty theft, Penal Code 488, is Cite and Release. Grand theft over $950, 487(a), is Book and Release; grand theft from a person, 487(c), goes to Magistrate Review.
A hit-and-run with property damage only, Vehicle Code 20002, is Cite and Release. Evading an officer, 2800.1, goes to Magistrate Review. A bond matters once a judge endorses bail on a warrant under Penal Code 815a.
Under Penal Code 849(b)(2), officers may release a person held only for intoxication when no further proceedings are desirable. A 647(f) charge is Cite and Release at $0, yet felony probation or parole sends the case to a magistrate.
Assault with a deadly weapon other than a gun, Penal Code 245(a)(1), is a serious felony, and the 2026 schedule sets $30,000 bail. With a semiautomatic firearm, 245(b), it reaches $75,000. Zero-dollar release excludes serious felonies.

In most cases, no, and dropped charges do not change that. If the agent surrenders your relative before a court date, though, 10 CCR 2090 requires a refund, minus limited costs on proof of a major rise in risk. Penal Code 1300(b) lets a court order one after a groundless surrender.
