California law calls it DUI. Los Angeles County’s 2026 bail schedules give each charge below a designation, and five of the six carry no money bail before arraignment.
Driving under the influence, or at 0.08 percent blood alcohol or more, violates Vehicle Code 23152. The 2026 misdemeanor schedule lists it as Book and Release at $0; with two or more priors alleged within ten years, it becomes Magistrate Review.
A DUI can become a felony under Vehicle Code 23550 after three or more DUI-type convictions in ten years, or under 23550.5 after a prior felony DUI. The felony schedule lists both as Magistrate Review, and a magistrate rules on release.
Vehicle Code 23153 covers an impaired driver who breaks a law or neglects a duty and injures someone other than the driver. Both 2026 schedules list it as Magistrate Review at $0, and no one can post a bond while the magistrate decides.
A VC 23153 charge alleging personal infliction of great bodily injury on anyone but an accomplice, or personal use of a dangerous or deadly weapon, is a serious felony under Penal Code 1192.8. The 2026 felony schedule sets $100,000 bail.
A driver who knows the DMV suspended or revoked their license for a DUI conviction and drives anyway violates Vehicle Code 14601.2; 14601.5 covers refusal and 0.08 suspensions. Both are Cite and Release: a citation, no booking.
Fleeing a marked police car with a lit red lamp and siren is a misdemeanor under Vehicle Code 2800.1. With willful or wanton disregard for safety, it falls under 2800.2, a possible felony. The 2026 schedules list both as Magistrate Review.

DUI Bail Bond FAQ

California sets no single figure: Penal Code 1269b has each county’s judges adopt a bail schedule. Los Angeles County’s 2026 schedules list a first misdemeanor DUI as $0 Book and Release and a felony or injury DUI as $0 Magistrate Review. A DUI with great bodily injury carries $100,000.
Often not. Under the Pre-Arraignment Release Protocol, a first misdemeanor DUI carries $0 bail. Felony and injury DUI charges without great bodily injury go to a magistrate, who may release the person or hold them until arraignment, and the arraignment judge can still set money bail.
With a bondsman, a $1,000 bond costs a $100 premium, because the standard premium is 10% of bail. A $100,000 DUI bond costs $10,000, as our cost guide shows. Veterans and clients who hired a private attorney may be eligible for a lower filed rate of 8%.
Cash costs less if you can spare the full bail; bonds cost 10%. Penal Code 1297 lets the court apply a defendant’s deposit to restitution, fines and costs and refund the rest; a parent or friend who deposited gets it all back after judgment, within 10 days of their claim and receipt.
Police can book and release a first misdemeanor DUI arrestee at $0 bail but may hold one who remains intoxicated. Anyone facing Magistrate Review or on felony probation or parole goes to a magistrate, who may hold them; Penal Code 825 requires arraignment within 48 hours after arrest, excluding Sundays and holidays.
